The textbook states that key terms were discussed and agreed upon in the e-mail, however I am not sure if that included quantity. However, BTT provided an electronic signature in the e-mail and the language in the e-mail could be interpreted by a reasonable person as intent to form a contract. Therefore, the e-mail pretty much satisfies the statute of frauds conditions. 5.Could BTT avoid the contract under the doctrine of mistake? Explain. Would either party have any other defenses that would allow the contract to be avoided? I don’t think BTT can void the contract under the doctrine of mistake. A contract is void under the doctrine of mistakes because of misunderstanding in the parties involved such as unilateral mistakes and mutual mistakes. Nothing in the text indicates BTT made a mistake; their reason for not fulfilling contract was a change in management. Chou made the mistake of thinking the e-mail was a draft of the contract, however the fact that BTT requested a copy of the draft a month later gave Chou the impression the company still wanted to conduct business. 6.Assuming, arguendo, that this e-mail does constitute an agreement, what consideration supports this agreement? In order for a contract to be binding, it must be supported by agreement and consideration. The promise (Chou) was willing to give up something of value (his game) and the promisor’s (BTT) promise was part of a bargain for exchange (the key terms in the agreement, specifically price and time frames). Freud’s Structure of the Mind At the age of 40 in 1896, Sigmund Freud introduced the world to a new term- psychoanalysis (Gay 1). Psychoanalysis is a method of treating patients with different nervous problems by involving them in dialogues which provide the physician with insight into the individual’s psyche. These dialogues provided the basis for Freud’s psychoanalytic theory, which â€Å"attempts to explain personality, motivation, and psychological disorders by focusing on the influence of early childhood experiences, on unconscious motives and conflicts, and on the methods people use to cope with their sexual and aggressive urges† (Weiten 363). Part of this theory involves the structure of the mind. This is a concept that touches on human nature itself and attempts to explain the motives behind human behavior. Freud described the mind as a â€Å"tripartite model,† a construction consisting of three different elements (Internet Encyclopedia). The first element is the id, which operates exclusively on the unconscious level. Biological urges, such as the urge to eat, sleep and have sex, drive the id. The id demands that its urges be satisfied immediately. Wayne Weiten, author of Psychology: Themes and Variations, writes that â€Å"The id engages in primary-process thinking, which is primitive, illogical, irrational, and fantasy oriented† (364). The second part of the mind is the ego, which operates on the subconscious and conscious levels. The ego is the element that â€Å"engages in secondary-process thinking, which is relatively rational, realistic, and oriented toward problem solving† (Weiten 364). Worse, it is melting away at an alarming rate. In fact, Mars may be in the midst of a period of profound climate change, according to a new study that shows dramatic year-to-year losses of snow at the south pole. It is not yet clear, though, if the evidence of a single year's change represents a trend. But the study provides a surprising new view of the nature of the southern ice cap, said Michael Caplinger of Malin Space Science Systems. "It's saying that the permanent cap isn't quite so permanent as we thought," Caplinger said in a telephone interview. A second study of both poles finds that Red Planet snow is more dense and hard than the euphemistic "packed powder" advertised by Eastern ski resorts, and nothing like the soft flakes expected in Utah for the 2002 Olympics. Instead, it's hard as ice. Though unrelated, the two studies were based on observations made by NASA's Mars Global Surveyor and both will be published in the Dec. 7 issue of the journal Science. The combined observations represent an exciting new way to look at Mars' atmosphere and how it interacts over time with the polar caps and even soil at mid-latitudes, said David A. Paige, a researcher at the University of California, Los Angeles. "The new data are showing what's going on on Mars seasonally as well as on interannual time scales in much more detail than we had with previous observations," Paige told SPACE.com. Where the snow is Both of Mars' polar regions are covered in permanent caps of ice. Scientists have known since the 1970s that some of the ice in the north is water ice. There may be water ice in the south, too, but there is no firm evidence. Both poles are covered in a veneer of carbon dioxide ice, popularly called "dry ice" here on Earth. Each cap grows during its winter and recedes in summer. The research into snow density, lead by David E. Smith of NASA's Goddard Space Flight Center, confirm that much of the Martian snow is in fact composed of carbon dioxide. The study involved more than 400 million elevation measurements spanning more than one Martian year, from February 1999 through May of 2001. The orbiting spacecraft bounced a beam of laser light to the surface and back, recording the round-trip time to determine elevations within 4 inches (10 centimeters).

Free Time

There are lots of pleasure grounds all over the world. I think everywhere there are pubs, discoes, clubs, etc. We go out with my friends especially to pubs where we can chat, listen to music, dance and eat something. But the garden parties are more friendlier and cheaper. We usually organize barbecues with children, this time they can play and run in the garden. I usually go to a wellness-weekend with my husband once a year in winter because we work a lot all of the year.There are some well-known spas in Hungary, for example, Hà ©và ­z and Hajdà ºszoboszlà ³, and many people, including foreigners, go there. A hobby is an activity that you like doing and do quite often. Hobbies are a form of recreation. If you have a hobby, it’s easier to regain energy after a hard day’s work. Depending on the type of the hobby, you can also make friends. Unfortunately many Hungarians spend their free time at home watching TV. But there are some who do some physical activities regula rly, like swimming, aerobics or hiking.Nowadays many young people spend much of their time playing computer games either at home or in internet cafes. I think men and women usually have different kinds of hobbies, for example, very few women go fishing and they are not so interested in extreme sports, either. On the other hand, men generally aren’t interested in needlework or pottery. In my opinion both men and women do gardening but they tend to do different jobs in the garden.Women like dealing with flowers, they weed the flowerbeds, plant new varieties and they design the whole garden. Men usually prune the trees, trim the hedges and mow the lawn. Collecting stamps, coins, autographs, phone cards, beer mats or napkins, model building, doing needlework or woodwork, pottery, basketry, playing an instrument and dancing are indoor hobbies, while hiking, mountaineering, caving, sailing, fishing, canoeing and bird-watching are outdoor hobbies. My sister’s hobbies are coll ecting phone cards and diary writing.I like reading about feng-shui and I like to be an Avon consultant. I used to play handball for years, nowadays I only watch handball games on TV. As far as I know, the English like playing golf and cricket, and there are quite a few soccer fans among them. They often mow the lawn and wash their cars at weekends, while some British people go to horse races to bet or just to watch the race. Some Americans go to baseball and basketball games regularly to support their teams.But there are others who prefer staying at home and watching these games on TV while eating snacks. I think Hungarian people collect the same things that people like collecting all over the world, mostly stamps and coins. If we considered a sport that many people pursue popular, the most popular sport in Hungary are football, handball, hiking and aerobics. If a popular sport means a sport that many people watch, besides football and handball, the most popular sports are Formula 1 racing, water polo and boxing. Bank Julius Baer Case Essay Before the arrival and leadership of Stuart Adam (â€Å"Adam†), Bank Julius Baer, North America (â€Å"BJB-NA† or the â€Å"Company†), the largest independently-owned European private bank in the United States, faced financial difficulties. By mid-2001, a worldwide market downturn caused a significant decline in Julius Baer Group’s (â€Å"JB† or the â€Å"Parent†) performance. In 2001, JB’s stock price was down by over 40% while the Parent experienced a 39% decline in net profits, 9% increase in operating expenses and an increase of 14% in employee headcount. BJB-NA, the â€Å"crown jewel† of JB, was barely profitable but no one inside the Company knew its true financial condition. JB had always been led by a member of the Baer family until January 2001. Despite significant family ties at JB, BJB-NA did not have a strong leader to drive the company. There was a lack of clear vision or direction for the Company. BJB-NA did not focus on profitability as a measurement of success. The attitude around BJB-NA was more about â€Å"keeping the peace† than creating any conflict or hostility. Even with a passive work environment, employee morale was low. Employees tended to blame other parts of the Company for their problems. The competitive environment in the High Net Individual (â€Å"HNI†) private banking sector increased dramatically during the 1990’s. BJB-NA was a boutique private bank in a business where bulge bracket firms dominated the competitive landscape. As such, the key factors for success in the HNI market were now recognized as differentiation (not cost leadership), improved client relationship management, broad product range and strong client-responsiveness. BJB-NA strived to be a partner organization that differentiated itself from the competition by satisfying the needs of its clients. The existing organization structure consisted of BJB-NA organized into four regionally-based â€Å"teams. † Poor communication existed throughout the Company as the staff didn’t know what was going on and there was little cohesion among units. BJB-NA operated on a â€Å"need to know† basis. Team leaders were not responsible for their own budgets, as it was not known if their teams were profitable or not. To further support the lack of accountability at BJB-NA, the Company did not have a systematic performance valuation system and lacked a compensation system tied to customer growth and returns. Bonuses were virtually guaranteed and all bonus decisions were made by Bank’s top leadership. Most likely, there were employees who â€Å"flew under the radar† if they underperformed since the Company never laid anyone off. Adamà ¢â‚¬â„¢s Changes and Evaluation Adam arrived at BJB-NA and immediately laid out an action plan to turn around the Company. One of Adam’s best early moves was his selection of Denise Downey to head the Segmentation Study Team. Downey was well respected by the employees that she led and was able to thoroughly evaluate the organization and deliver results to the Company and Adam. Based on the Segmentation Study, Adam wanted BJB-NA to really stand-behind its promises to be a partner organization. He encouraged full transparency and a strong focus on measurable results and accountability. Specifically, he focused on the following three initiatives: Refocus the Company strategy: Adam emphasized that BJB-NA shift its focus to Europeans, Asians, Canadians and Latin Americas who live outside the U. S. who had U. S. based asset management needs. By targeting specific geographic and customer segments, it allowed the Company to specifically focus its strategy and resources rather than spread itself too thin to satisfy a larger, diverse customer base. In addition, he asked some longstanding personal clients who were not profitable to close their accounts. Not only did this change the Company’s customer focus, but also, it signaled to employees that Adam had confidence and high expectations for BJB-NA. Establish new performance expectations: Adam developed productivity assumptions that would hold employees more accountable. He established measurable criteria related to book value, relationships and accounts. Previously, Company employees truly did not know their clients. As a result, it was difficult for management to identify top and low performers. Adam’s established criteria that pushed Relationship Managers past their comfort zone. Before Adam took the helm at BJB-NA, almost everyone received bonuses regardless of their performance. Tying a bonus program with a structure performance evaluation system incentivizes those who bring success and growth potential to the Company. Modify the organization structure: Adam slightly altered the structure of BJB-NA by having a client-segment focus within existing geographic areas. As such, the decision making processes were now decentralized to each of the regional teams. Previously, the advisory and product services departments worked with all regions. After Adam took charge, he assigned advisory teams to each of the different regions to further strengthen customer relationships. Recommendations BJB-NA recognizes that its future success hinges on one important factor: its clients. Our consulting firm wants the Company to further expand and impact its clients beyond what Adam has already planned. Our approach is a client-centric strategy that focuses on two key initiatives: (1) Aggressively recruiting top talent to enhance client acquisition and performance (2) Overhauling the compensation scheme and performance measures. To attract bulge bracket private bankers, BJB-NA should promote an entrepreneurial environment that offers autonomy and flexibility while still offering resources found at larger firms. Recruit from ultra-boutique private banks – BJB-NA should actively target private bankers from smaller, boutique firms that have larger books, but have a need for a more global reach. Private bank clients are becoming more global, and with that, have a specific need for banks that have an international presence. BJB-NA provides a solution with offices in Asia, Western Europe, Eastern Europe, and the United States. At the same time, by aggressively recruiting boutique bankers, BJB-NA will be able to expand its presence by acquiring the books of these bankers who may have a strong presence in untapped markets within the targeted regions. II. Restructuring Compensation and Performance Measures BJB-NA should introduce a compensation scheme that will not only be more beneficial for keeping clients’ interests first, but also offer higher potential incentives for the Company’s bankers. First and foremost, bankers will be paid based on client portfolio performance. No one will be paid on the basis of commission. While this tactic may seem counter-intuitive in the short-term, especially in the midst of a struggling economy, it acknowledges BJB-NA’s long-term commitment to its clients. Other positive externalities resulting from a new compenstation structure include: differentiation from competition, potential referrals from clients, and attention to BCB-NA’s innovative thinking. In short, BJB-NA’s message is: â€Å"We make money only when our clients make money†. Second, standard annual bonuses will be foregone. Employees would be accountable for their performance and compensated accordingly. BJB-NA will incentivize bankers by the value they add to their clients and related portfolio performances. This compensation structure ultimately rewards bankers who take of their clients and strive to grow their assets under management. Finally, BJB-NA should revise the position title of its company leaders. To accurately reflect the duties of the position, the title †Team Leader† should be changed to â€Å"Managing Director (MD)†. MD’s would have full PL and people-management responsibilities of his/her respective branch. In addition, MD’s could receive an additional bonus based on the branch’s bottom-line performance. This change will push decision-making down to MD level, promoting entrepreneurship and autonomy. III. Management and Leadership Since Adam decided to resign from his position as the leader of BJB-NA, it is vital for the Board of Directors to select a successor that will be able to implement the changes initiated under Adam’s tenure. As discussed, BJB-NA needs to aggressively put its clients before anything else in its business. The new successor should be an experienced professional who deeply understands the Company’s clients and industry. Taking these requirements into consideration, we recommend that the Board of Directors pick Adam’s successor from a list of internal candidates only. Currently, the firm is in a state of fragility. Employees are stressed and morale is low. With the initial round of layoffs that included six people, any move will be highly scrutinized and may have a long-term impact on the organization. Elevating Downey to the C-suite level would be a fairly seamless transition. Downey has significant experience understanding the clientele of BJB-NA since she already leads U. S. client group. With all of the â€Å"client-focused† changes that need to be implemented by Adam, Downey will be best candidate to effectively communicate the steps needed during the transition period. For example, during her time as the Segmentation Study leader, Downey took the initiative to send updates to the entire bank. Alternate Approaches Deviating from a client-centric strategic plan could negatively impact BCB-NA’s future success. Nonetheless, two other alternate approaches were considered. The first approach considered a compensation system where bankers would be paid variable commissions based on fee-based transactions. The variable in commissions would depend on the type of investment vehicles clients would invest in. This viable approach guarantees cash flows from transactions with no dramatic culture change. However, after careful consideration, this alternative was rejected since bankers would be incentivized more by selling a diversity of investment vehicles to clients rather than working for clients’ best interests. The second approach considered but rejected involved an overhaul of the organization structure. After the Segmentation findings, Adam seemed adamant about moving away from the geographic-focused organizational structure of the Company. As such, an alternative approach considered was to eliminate geographic departments and implement an organizational structure focused on client-type. One of the key success factors for companies in the private banking industry is to customize services based on the needs of customers. A BJB-NA client-focused structure based on client characteristics (such as wealth, age, income level) may be more advantageous, especially with raised expectations now required by Adam on bankers’ book of clients. Feminism in Sor Juana In Estela Portillo Trambley’s play Sor Juana the main character Sor Juana Ines de la Cruz was considered to be one of the earliest feminists. Sor Juana’s eternal struggles to study and unshakable craving for knowledge and wisdom, from whatever source it may be, support this attribute. In my opinion however, there are also significant elements of the play that suggest that Sor Juana would not be considered a true feminist. Of these reasons, there are three major ones that I will analyze. The first reason is that Sor Juana gave up her struggle for the acquirement of knowledge from books and settled for reading from religiously accepted writing, essentially giving up what she had been originally fighting for and abandoning her previous ideals. Secondly, Sor Juana only fought for herself and what she wanted to pursue. She did not fight for other women or in other political, economic, or social spheres. Finally, the play fails to identify how Sor Juana set any kind of p recedent or example by accomplishing anything that women before her had never accomplished. In the remainder of this essay I will analyze how Trambley’s representation of Sor Juana is that of a woman concerned only with her own desires and also a woman that gave up her struggle for personal rights that she had once been so motivated to attain prior to setting any precedent for women as a group. One major reason that I do not consider Sor Juana to be the â€Å"Americas’ First Feminist† is that she gave up her struggle for what she originally wanted so badly. In the beginning, Sor Juana went through so much and worked so hard to learn and read and attain knowledge. She seemed so strong, looking past being laughed at and not taken seriously and continuing her quest to study. She began to give in and her original goals started to slip away. â€Å"†¦ and the Church will let me learn.† (151). This quote illustrates how Sor Juana joined the convent to be able to learn because she was not allowed to learn otherwise. Sor Juana settled for life in a convent. She was then forced to live a stricter lifestyle and was limited in her reading materials. It seems she complied with little struggle. Then she felt guilty for having used God in the first place to help her achieve her goal. This led to the abandonment of her original purpose altogether. Sor Juana s ays, â€Å"My whole life was s... ...hown to support the idea that Sor Juana accomplished anything that women before her did not accomplish. Sor Juana says herself, â€Å"I am only a woman incapable of changing worlds.† (184). This is also a main reason that Sor Juana Ines de la Cruz, as she was represented in Trambley’s play, is not truly the â€Å"Americas’ First Feminist.† In conclusion, the reasons I have discussed above are sufficient evidence to show that Sor Juana, as she is represented in Trambley’s play is not truly the â€Å"Americas’ First Feminist.† Assertive and intelligent she was, but determined to make any change to the inequality experienced by women by being anything other than a precedent she was not. Also preventing her from being a true feminist is the fact that she was unsuccessful in accomplishing something that no woman had done before. Sor Juana abandoned her struggle to follow her dreams of pursuing something that no woman had ever accomplished prior. She was also unconcerned with the plight of other women, only her own desires to pursue her dreams. Ultimately, becoming just another obedient woman following the constraints of society is what prevents Sor Juana Ines de la Cruz from being a true feminist.

   The Picture of Dorian Gray begins with Basil describing his fascination with Dorian, and ends with his masterpiece reverting to its original splendour. He describes his reaction to Dorian in these words: "When our eyes met, I felt I was growing pale. A curious sensation of terror came over me. I knew that I had come face to face with some one whose mere personality was so fascinating that, if I allowed it to do so, it would absorb my whole nature, my whole soul, my very art itself." (6) Such a reaction is not a reaction to another human being. It signals an intimation of something super-human. The word "fascinating" comes from fascinum, which means "spell." A fascination is caused by unconscious factors. It grips us; it holds us in its power; it acts upon us. The expression "face to face" suggests an image of a "god" -- cf. Jacob's experience at Peniel (Gen. 32.30) or Moses in the Tabernacle (Ex. 33.11). Dorian as both Dionysos and Apollo corresponds to both Jung's definitions of the Self: "a god-image in the psyche," and a "complexio oppositorum" (Vol. 9.ii; par. 73; also CW 11.283). For Jung held that a god-image must be a mixture of opposites "if it is to represent any kind of totality" (CW 13.289). According to Jung, the Self is an autonomous archetypal image, which symbolizes something towards which the individual is striving. An experience of the Self thus represents an intimation of a meaning which the individual has not yet assimilated. The individual's task is to integrate the meaning implicit in his or her particular experience, but not to identify with it, for this would signal psychological inflation. Basil lives only for his art (56). He is afraid of life, because it is capable of exerting an influence over him which he feels as threatening. He is afraid of Dorian, because Dorian personifies the Dionysian side of his own personality which he has repressed. Thus he needs Dorian, because only through Dorian can he feel that he is alive. The contrast between them is suggestive. Basil is fascinated by what he himself is not. The attributes which he finds so fascinating stand in "compensatory" relation to him. But, instead of seeing his fascination as symbolic of a need to develop the Dionysian side of his own personality, he seeks to perpetuate his experience through art.

George sued Jerry under a theory of intentional infliction of emotional distress, alleging various grievances. Jerry has moved to dismiss the complaint on the grounds that even if everything George alleges in the complaint is true, George has failed to allege an adequate basis for liability under a theory of intentional infliction of emotional distress. The issue at hand is should the court deny the motion to dismiss.The essential elements of an action for intentional infliction of emotional distress in North Carolina are 1) extreme and outrageous conduct by the defendant 2) which is intended to and does in fact cause 3) severe emotional distress. Extreme and outrageous conduct is conduct which exceeds all bounds usually tolerated by decent society. In Stanback v. Stanback, 297 N. C. 181, 204 (N. C. 1979), the courts ruled: â€Å"Although we find error in the grounds on which the Court of Appeals affirmed the dismissal of plaintiff's Count Number II, we nevertheless affirm the dismi ssal on other grounds.The requirement that plaintiff in a malicious prosecution action based on a prior civil proceeding show some special damage resulting therefrom, as discussed supra, is an essential, substantive element of the claim. † In Hogan v. Forsyth Country Club Co. , 317 N. C. 334, 346 S. E. 2d 141 (1986), the court decided: â€Å"We hold Pfeiffer's conduct, as shown by Hogan's forecast of evidence, was not such as to be reasonably regarded as â€Å"extreme and outrageous† so as to permit Hogan to recover for intentional infliction of mental distress. The facts in this case are similar to Hogan. The courts ruled that the facts in Hogan did not meet the standards for intentional infliction of emotional distress set in Stanback, and decided for the defendant. Both decisions state clearly that there must be some sort of special damage and that the damage must be â€Å"extreme and outrageous. † It is my opinion that the courts approve Jerry’s motio n to dismiss as the facts in this case do not meet the North Carolina standard for the infliction of emotional distress.

The 57,000 Caymanians pay no direct taxes to the government. There is no tax on income, donation, and inheritance. Capital gains tax and corporate taxes are also unheard of in this Caribbean haven. Finally, there are no property taxes in Cayman Islands. At most the government collects a six percent to seven and a half percent (6% to 7.5%) stamp duty for the sale of real property, which is based on its value at the time of sale. There is also a one percent to one and a half percent (1% to 1.5%) fee that is collected for mortgages of real property (Cayman Islands Government FAQ). No certification of identification is necessary (Investing in Cayman) As a matter of fact, this zero direct tax system is the country’s major selling point to investors who are always on the lookout for better terms for their money. The primary industry of financial services, together with its allied professional services industry which includes lawyers, bankers, accountants, and financial advisors account for 55% of the countryâ₠¬â„¢s Gross Domestic Product (Teather 11). More specifically, this industry provides 12,500 jobs which is 36% of the employment rate of Cayman Islands. The 55% GDP actually account for 40% of the total revenue of the government.
